General Overview
Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, hereinafter referred to as GDPR) was adopted by the European Parliament and the Council of the European Union on April 27, 2016, its provisions being directly applicable starting from May 25, 2018. This Regulation expressly repeals Directive 95/46/EC.
The Regulation is directly applicable in all Member States, protecting the rights of all natural persons within the territory of the European Union. From a material point of view, the Regulation applies to all operators processing personal data. The Regulation does not apply to the processing of personal data concerning legal persons and, in particular, undertakings with legal personality, including the name and the type of legal person and the contact details of the legal person.
Personal data are defined as any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Processing of personal data means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Situations where processing of special data is permitted
Considering that the Regulation mainly prohibits the processing of sensitive personal data, situations where such processing is permitted are established:
- There is explicit consent from the data subject;
- Processing is necessary for carrying out obligations and exercising specific rights of the controller or of the data subject in the field of employment and social security and social protection law;
- Processing is necessary to protect the vital interests of the data subject or of another natural person;
- Processing refers to personal data which are manifestly made public by the data subject;
- Processing is necessary for the establishment, exercise or defense of legal claims;
- Processing is necessary for reasons of substantial public interest.
Obtaining Consent
For the processing of personal data to be lawful, GDPR requires it to be based on a legitimate ground, such as the performance or conclusion of a contract, compliance with a legal obligation, or based on the valid consent previously expressed by the data subject.
Consent must be given by a statement or by a clear affirmative action signifying agreement to the processing of personal data relating to him or her. In the case of a written declaration which also concerns other matters, the request for consent must be presented in a manner which is clearly distinguishable from the other matters.
